Terms and Conditions

I. GENERAL:
1. ThompsonGas Easy Choice Home Comfort programs are not insurance policies; each are an agreement to service covered appliances in good operational condition, at the time of coverage date. ITEMS OVER 12 YEARS OLD ARE EXCLUDED FROM THIS PROGRAM.
2. Each plan is purchased for one year, payable in 12 equal monthly installments.
3. Each program has a 90-day waiting period between enrollment and first service request.
II. PLAN DESCRIPTIONS:
1. Home Comfort Plan - For $20.95/month, the following appliances may be covered:
a. One hot air unit - gas only
b. One water heater - gas or electric
c. One Air Conditioner or Heat Pump Unit
(If you have multiple systems in your home the monthly fee is calculated by multiplying the number of systems in your home by the monthly fee stated herein.)
2. The plan applies to a single-family or multiple unit residential property solely determined by ThompsonGas, and only to the specific equipment covered by the plan at the time of your initial application. This plan is not intended for Landlords or Realtors, you must be the sole owner and user of the appliances.
3. As a condition of participation, your equipment must satisfy applicable codes and be in good operating condition at the time of your application. You understand and agree that ThompsonGas is not liable in any manner for your defective equipment, whether such defect is discovered at the time of sign-up or at a later date. A pre-inspection may be required. ThompsonGas reserves the right to reject any application.
4. ThompsonGas reserves the right to exclude certain equipment due to the inability to service said equipment. The method chosen to service the equipment is left to ThompsonGas' discretion.
5. ThompsonGas shall not be held responsible for charges for service or plans performed or procured by you or performed by non-participating service technicians.
6. Upon your notification to us of a suspected problem, ThompsonGas will endeavor to give efficient and prompt service to any appliance covered under the plan; although response time shall be governed by weather conditions and work load. Covered service will be performed during normal working hours, Monday through Friday, except for primary heating and water heating, which is covered 24 hours a day.
7. Your participation in this plan may be subject to state or local taxes.
III. LIMITATIONS OF LIABILITY/EXCLUSIONS:
1. ThompsonGas will not be responsible for direct, indirect, incidental, or consequential damages, illness, or injury caused by delays, failure to service, labor difficulties and other conditions beyond ThompsonGas’ control, arising from ThompsonGas' performance under this plan. ThompsonGas further reserves the right, at its discretion, to use participating service contractors to fulfill all or any part of its obligations under this plan.
2. The plan does not include service for equipment required as the result of abuse, vandalism, fire, freezing, acts of God, power or water supply outages, flooding, or other abnormal conditions.
3. The plan does not include labor and materials for compressors, cleaning of boiler water, cleaning of cooling coils, cleaning of air ducts, venting, adjusting air flow to rooms, venting of radiators, draining of expansion tanks, disconnection of appliances for cleaning, or installation of new or replacement appliances, evaporative pads, water heater tank, furnace heat exchanger or regular maintenance service such as seasonal pilot lighting. However, as a Home Comfort Plan customer, you are entitled to a discounted service charge for any of the above mentioned services.
4. Being mechanical, your equipment may wear out. If the estimated cost of service should exceed the fair market value of your covered equipment, ThompsonGas reserves the right not to service the appliance and to recommend replacement by you. Again, as a Home Comfort Plan customer, you are entitled to a discount for replacement equipment.
IV. COVERAGE AND RENEWAL:
1. Your coverage under these plans commences 30 days after your enrollment, and extends for one year from that date. ThompsonGas will automatically renew the plan each year thereafter, unless the plan is terminated by either party giving 30 days written notice to the other party, prior to the end of the initial or any renewal term.
2. Charges for this plan may be changed at any time after the initial one year term, with 30 days notice. You may terminate coverage prior to the effective date of any increase. Such notices may be given at any time without stated cause or reason. You may be dropped from the program for non-payment. If dropped for nonpayment, you agree to promptly pay ThompsonGas the full cost for all services provided you after your last payment period.
3. If you desire to cancel before the yearly period is over, you may do so if you have not received services costing more than the amount you have paid up to the last day of the month you desire cancellation. If you have received services costing more than the amount you have paid into the plan, you may cancel by paying the difference between the amount of costs incurred by ThompsonGas and the amount you have paid into the plan.
